Firehouse DC: Terms and Conditions
1. Introduction
Welcome to Firehouse DC. These Terms and Conditions Agreement (“Agreement”) constitutes a legal, binding agreement between you and Firehouse DC (“Firehouse,” “we,” “us,” or “our”). It describes the terms that govern your use of our website, https://www.firehousedc.com/ (the “Site”), our luxury retail dispensary located at 912 U St NW, Washington, DC 20001, and any related services, promotions, or communications (collectively, the “Services”).
THE DISPUTE RESOLUTION SECTION OF THIS AGREEMENT CONTAINS A MUTUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT REQUIRES YOU AND FIREHOUSE DC TO RESOLVE DISPUTES WITH EACH OTHER ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION. PLEASE REVIEW THE DISPUTE RESOLUTION SECTION CAREFULLY. BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT.
2. Acceptance and Amendments to This Agreement
- Acceptance: By accessing or using our Services, you hereby expressly acknowledge and agree to be bound by all terms and conditions of this Agreement and our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the Services.
- Amendments: Firehouse DC may, in its sole discretion, modify or update this Agreement from time to time. Any changes will be published through our Site and are effective upon publishing. If we make material changes, we may notify you via the email address associated with your patient profile. Your continued use of the Services after any such changes constitutes your acceptance of the new Agreement.
3. Important Disclaimers & Acknowledgements
- Firehouse DC is a Licensed Dispensary: You expressly agree and acknowledge that Firehouse DC is a licensed medical cannabis dispensary operating in full compliance with the laws of the District of Columbia and the Alcoholic Beverage and Cannabis Administration (ABCA). We are a direct provider of curated cannabis products to registered patients.
- Acknowledgement of Federal Law: You expressly acknowledge that marijuana (cannabis) is listed on Schedule I of the United States Controlled Substances Act. Under federal law, manufacturing, distributing, or possessing marijuana is illegal. Medical use is not a recognized defense under federal law. All activities related to cannabis are undertaken at your own risk.
- Acknowledgement of D.C. Law: You expressly acknowledge and agree to use the Services and any products purchased only as permitted by the laws of the District of Columbia. You assume full responsibility for complying with all local laws and regulations regarding possession, consumption, and transport.
- Health Information Disclaimer: You expressly acknowledge that any statements relating to cannabis goods on our Site or provided by our staff have not been evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease. The information provided is for educational purposes only and is not a substitute for informed medical advice from a licensed healthcare provider.
4. Using the Firehouse DC Services
- Your Patient Profile (“Account”): To use our Services, you must register for and maintain an active patient profile (“Account”). This requires you to submit certain personal information as detailed in our Privacy Policy. You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to do so may result in your inability to access the Services.
- Account Security: You are responsible for all activity that occurs under your Account and agree to maintain the security and secrecy of your account information. You may only possess one Account. You are the sole authorized user of your Account, and you may not assign or transfer it to any other person.
- Patient Eligibility Requirements: To purchase products, you must be a qualifying patient under the D.C. Medical Cannabis Program. You agree to provide a valid, unexpired government-issued ID and a valid D.C. medical cannabis registration (or a valid registration from a reciprocal state) for verification.
- Age Restrictions: You must be at least 21 years old to purchase medical cannabis, or between 18-20 with a valid healthcare provider’s recommendation, as stipulated by D.C. law. By using the Services, you expressly represent that you meet the qualifying age.
- Communications from Firehouse DC: By creating an Account, you agree to accept and receive communications from us, including via email and text message. These may include transactional communications concerning your account or purchases, and (if you opt-in) promotional communications about new products and offers. Standard messaging rates from your carrier may apply. You may opt out of promotional communications at any time by following the unsubscribe instructions in the message.
- Electronic Records: You consent to receive communications, records, receipts, and notices from Firehouse DC electronically. You agree that your electronic signature on any agreement or document is the legal equivalent of your manual signature.
5. Charges, Billing, & Refunds
- Charges: You understand that you will incur charges for goods purchased through the Services (“Charges”). All Charges will be identified at checkout and in your receipt. Charges will include the retail price of products plus all applicable D.C. taxes as required by law.
- Pricing: Firehouse DC reserves the right to determine final prevailing pricing. Pricing information on the Site may not always reflect the most current price.
- Refunds: All Charges are due immediately and are non-refundable. All sales are final. This no-refund policy shall apply at all times. If you are dissatisfied with any product you receive due to a verifiable defect, please contact our staff for assistance.
6. Third-Party Brands and Product Descriptions
- Third-Party Brands: Our luxury dispensary offers products expertly curated from various renowned pop culture and artisan brands. Firehouse DC is not responsible for the packaging, labeling, or testing of products manufactured by third-party brands.
- Product Descriptions: We attempt to be as accurate as possible in product descriptions. However, we do not warrant that product descriptions, images, or other content are accurate, complete, reliable, current, or error-free. You acknowledge that cannabinoid percentages (e.g., THC, CBD) are provided by the manufacturer, are subject to variance, and should be treated as estimates.
7. Promotions
Firehouse DC may, in its sole discretion, make available certain promotions or offers. Each promotion (i) must be used for the intended purpose and in a lawful manner; (ii) may not be duplicated, sold, or transferred; (iii) is not valid for cash; (iv) may expire prior to your use; and (v) is void where prohibited. Additional terms may apply.
8. Privacy & Confidentiality
Our collection and use of your personal information in connection with the Services is described in our Privacy Policy. You agree not to use or disclose any non-public, confidential information related to Firehouse DC’s business or other patients that you may be exposed to.
9. User Conduct and Restricted Activities
With respect to your use of the Services, you agree you will not:
- Violate any law, statute, or regulation of the District of Columbia.
- Impersonate any person or entity.
- Stalk, threaten, or otherwise harass any person, including our staff.
- Post or transmit any content that is unlawful, hateful, defamatory, or otherwise offensive.
- Use the Services in any way that infringes on Firehouse DC’s or a third party’s intellectual property rights.
- Use any robot, spider, or other automatic device to scrape or “data mine” our Site.
- Attempt to gain unauthorized access to our computer systems.
- Resell, divert, or transfer any products for non-medical or commercial purposes.
- Consume products on the dispensary premises or in any public place.
- Discriminate against anyone on the basis of race, national origin, religion, gender, disability, or other protected status.
10. Intellectual Property
Firehouse DC owns all intellectual property rights in and related to the Services, including our name, logos, trademarks, and any custom in-house blends or original content (“Our IP”). This Agreement is not a sale and does not convey to you any rights of ownership in Our IP.
11. Dispute Resolution — PLEASE READ THIS SECTION CAREFULLY
- Agreement to Arbitrate: YOU AND FIREHOUSE DC MUTUALLY AGREE TO WAIVE YOUR RESPECTIVE RIGHTS TO RESOLUTION OF DISPUTES IN A COURT OF LAW BY A JUDGE OR JURY AND AGREE TO RESOLVE ANY CLAIM OR DISPUTE AGAINST EACH OTHER ON AN INDIVIDUAL BASIS IN BINDING ARBITRATION.
- Prohibition of Class Actions: You and Firehouse DC acknowledge and agree that you are each waiving the right to participate as a plaintiff or class member in any purported class, collective, or consolidated proceeding. Unless you and Firehouse DC agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims.
- Arbitration Rules and Governing Law: The laws of the District of Columbia will govern the interpretation and enforcement of this Agreement. The arbitration will be administered in accordance with rules agreed upon by both parties. [Consult your attorney to specify the governing rules, such as those of the American Arbitration Association (AAA), the location of arbitration, and the process for selecting an arbitrator.] All disputes concerning the arbitrability of a claim will be decided by the arbitrator.
12. Indemnification
By entering into this Agreement, you agree to defend, indemnify, and hold Firehouse DC harmless from and against any and all third-party claims, costs, damages, and losses arising out of or in connection with your violation of any term of this Agreement or any applicable law, or your use or misuse of the Services or products.
13. Disclaimer of Warranties
THE SERVICES AND PRODUCTS ARE PROVIDED TO YOU STRICTLY ON AN “AS IS” BASIS. FIREHOUSE DC MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE AS TO THE RELIABILITY, QUALITY, SUITABILITY, OR ACCURACY OF THE SERVICES OR PRODUCTS. ALL CONDITIONS, REPRESENTATIONS, AND WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
14. Limitation of Liability
IN NO EVENT SHALL FIREHOUSE DC BE LIABLE TO YOU FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY TYPE. FIREHOUSE DC SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR INJURY WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS, DAMAGE, OR INJURY ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE SERVICES OR PRODUCTS, EVEN IF FIREHOUSE DC HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15. General Provisions
This Agreement constitutes the entire agreement between you and Firehouse DC. If any provision is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. This Agreement may not be assigned by you without our prior written approval. The section titles in this Agreement are for convenience only and have no legal effect.
